Knowing Your Laws Before You Bid:
We reserve the right to refuse a bidding account to anyone. We are an FFL Dealer, and ALL Federal and State firearm laws govern every aspect of our online auctions, any infractions will be reported to your local law enforcement and the ATF. You must be at least 18 years of age to purchase a rifle or shotgun. You must be at least 21 years of age to purchase a handgun, this also includes “Other firearm” (receiver, frame & pistol grip shotgun). You must be at least 18 years of age to purchase long gun ammo and age 21 or older to purchase handgun ammo. You are responsible for knowing if your state allows any certain type of firearm, ammo and/or accessory to be shipped to you and your state. If you purchase an item that cannot be shipped to your state, you still must pay for your invoice and we will relist the item/s in the next up coming auction and issue you a check minus a 30% relisting fee. Know your state/federal firearm laws BEFORE bidding. All invoices must be paid. NO EXCEPTIONS.

Ammunition Shipments:
ALL AMMO IS SHIPPED VIA UPS GROUND

There are many restrictions across the country, and we will only ship ammunition to City and/or States where we legally can ship and/or there are no or certain restrictions. Below are the following States with restrictions.

ALASKA & HAWAII – Due to shipping restrictions we will NOT ship ammunition.

CALIFORNIA – We will not ship ammunition to L.A., Oakland, Sacramento, San Francisco or Avalon. The rest of CA we will ship to, only if it is sent and processed through an FFL (Federal Firearms Licensee) Dealer.

CONNECTICUT – We will only ship if bidder/buyer provides a valid certificate for ammunition or valid permit or certificate to purchase or carry a pistol, revolver or Long Gun.

ILLINOIS – We will NOT ship to the City of Chicago, however we will ship to all other areas in the state, you will need to provide a copy of your valid FOID card (Firearm Owner’s Identification Card) along with a copy of your state-issued ID.

MASSACHUSETTS – Local regulations prevent us from shipping and will NOT ship ammunition.

NEW JERSEY – The following calibers will be shipped without proof of a FOID card;
.223,5.56,.308,7.61×51,7.62×39,.270,.243,.30-30,30-06,12 or 20 Gauge, all other calibers will require one of the following: Valid copy of your FOID, Valid copy of your permit to carry or purchase a handgun.

NEW YORK – Local regulations restrict us from shipping to an address located in New York City, however we are able to ship anywhere else in NY but it must be shipped to an FFL holder OR a registered seller of ammunition.

WASHINGTON DC – Local regulations prevent us from shipping and will NOT ship ammunition.

PUERTO RICO & VIRGIN ISLAND – Due to shipping restrictions we will NOT ship ammunition

ONLY TYPE 1, 2,3,7, & 10 LICENSES WILL BE ACCEPTED.

(C&R) Curio Or Relics Licenses Will ONLY Be Accepted If The Bidder Emails Accurate Documentation Proving The Firearm Is Indeed Classified With Atf As Such. No Exceptions! Faxed FFL’s Are Accepted.

Returned/Refused Shipments:
If your shipment is returned or refused by any means or anyone. The item/s will be relisted in the next up coming auction and a check will be issued minus a 30% relisting fee and any and all shipping fees. NO EXCEPTIONS.

Bidder’s/Buyer’s Responsibility:
Read the descriptions of each firearm and view photos carefully. Conditions provided are only the matter of opinion, though we do our very best to give the bidders the best descriptions available, we are not gunsmiths and do not take guns apart – we cannot confirm if all of the internal parts are present on any firearm, nor do we test fire each gun, therefore we do not guarantee that they will fire correctly or function correctly. Ultimately it is the bidder’s responsibility to determine the condition of the firearm/s. Bidders are encouraged to make an appointment and personally inspect each firearm which you intend to bid. If in doubt DO NOT BID… by bidding YOU acknowledge and agree that YOU have had a full and fair opportunity to inspect the lot/s and you are relying solely on YOUR inspection or that YOU have waived inspection and that you have not relied on any description by STA, but choose to bid at your own free will and at your own risk. ALL ITEM ARE SOLD "AS-IS" "WHERE-IS". NO REFUNDS, RETURNS, or EXCHANGES.

PICKUPS MUST BE COMPLETED BY 3:00pm ON THURSDAY FOLLOWING THE AUCTION.

Arizona residents can pick-up in person with a Valid AZ ID that matches your Current Physical Address and a successful ATF Background Check.

IT IS THE BUYER’S RESPONSIBILITY:

  1. To contact their preferred FFL dealer in which to ship the firearm(s) to AND provide a copy of the FFL for shipment. Sierra Tactical Auctions will NOT contact the FFL dealer on your behalf unless it is a requirement by the FFL Dealer.
  2. To pay for the firearm(s) in full, including the Buyer’s Premium, Sales Tax (if applicable), $12 Administration Fee (Per Firearm / Excluding Accessories), and Shipping Costs. See Shipping Page
  3. Notify Sierra Tactical Auctions at firearms@sierratacticalauctions.com with any questions, concerns, or unforeseen circumstances that would result in non-payment of their winning bid(s). Sierra Tactical Auctions MUST RECEIVE ALL FFL INFORMATION, BACKGROUND CHECKS and PAYMENTS BY 3:00pm ON THE THURSDAY FOLLOWING THE AUCTION.

Only after these steps will Sierra Tactical Auctions arrange for shipping of the firearm(s). The buyer is responsible for any and all fees charged by the ship-to FFL dealer. It is Sierra Tactical Auctions policy that if you do not pass the NICS check completed by the ship-to FFL dealer, Sierra Tactical Auctions will refund your money, less $200 sale cancellation fee and associated return shipping costs. If the purchase is less than these costs, you will not receive a refund, as the funds paid will transfer to Sierra Tactical Auctions to cover the costs associated with the cancellation of the sale and shipping. You will be required to acknowledge these steps via signature or return email to firearms@sierratacticalauctions.com as part of the sale process.

Any Invoice can be paid with Credit Card, Direct Deposit, Wire Transfer, Certified Cashier’s Check, or through the link in your emailed invoice. You will receive an Invoice emailed from Sierra Tactical Auctions with Instructions.

Special Terms of Sale:
By participating and/or bidding in any of our auctions, live, onsite, or online, you are agreeing in full to our Terms and Conditions and Fee Structure of Sierra Tactical Auctions.

Per city code, if you are a City of Phoenix or a City of Tempe employee, you are not permitted to bid on any City of Phoenix or City of Tempe assets, either knowingly or unknowingly. By participating in our auction, you agree to this restriction & will abide to it.

Acceptable Payment Methods:

Credit and Debit Cards – A 3% surcharge will be added to the amount of your payment. A chargeback waiver form must be signed. For your protection Sierra Tactical Auctions will not charge your card on file or take payment over the phone.

Payments:
All payments are to be made in U.S. funds. A DAILY LATE PAYMENT FEE shall be charged on all lots not paid for in full by 3:00 PM on the day payment is due. Refer to special terms and conditions per auction for payment due dates. The DAILY LATE PAYMENT FEE SHALL BE equal to 3% of the outstanding balance of each lot or $10 per lot, per day, whichever is greater. Any lot not paid for by 3:00 PM on the specified payment due date shall place the Buyer in breach of contract. Sierra Tactical Auctions retains all its legal rights, including, but not limited to suing Buyer to compel specific performance, and/or declaring the Buyer in breach of contract retaining the deposit and barring the Buyer and Buyer’s agents from all future auctions. Sierra Tactical Auctions, at its sole discretion may offer the goods for sale in a private sale or any future Sierra Tactical Auctions auction. Buyer shall be responsible for any deficiency, including late payment fees and storage fees. Buyer shall have no right to any excess funds such sale may generate. Sierra Tactical Auctions reserves the right to change the fee structure, refuse to accept certain credit cards, and/or require cash payments in its sole discretion. SIERRA TACTICAL AUCTIONS DOES NOT ACCEPT PERSONAL OR BUSINESS CHECKS, MONEYORDERS, OR CASH.

Terms of Payment:
The Purchaser is YOU also known as the Bidder or Buyer will receive immediate notification of “Winning Bidder”, meaning you are the highest bidder and will have purchased the offered lot. All sales are final at the time of each notification for each lot. The purchase is subject to all the terms and conditions set forth herein. The purchaser assumes full responsibility thereof and if requested will sign a confirmation of the purchase followed with any documentation requested. The purchaser further agrees to pay the Total Amount Due of the invoice before shipping, the Total Amount Due must be paid in full by the 3rd day following the close of auction.

Auction Agreement:
By participating as an online bidder, you are agreeing to all our terms and conditions contained hereinafter as well as our fee structure. If you disagree with any of these terms, you are not permitted to bid through any Sierra Tactical Auctions hosted auction event in any location.

Sierra Tactical Auctions reserves the right to change these terms and conditions at any time at its sole discretion and without notice.

Sierra Tactical Auctions (“Sierra Tactical”) is acting as an auctioneer/agent for many cities, counties, the State of Arizona, many large and small companies and people just like yourself that are seeking to sell items they no longer need. Sierra Tactical may act as a Principal, Buyer or Seller in the sale of some items. Sierra Tactical is not responsible for the actions of its consignors and/or principals.

Registration:
All Buyers must register and be assigned a bidder number prior to bidding. Sierra Tactical Auctions reserves the right to deny access to its premises to any buyer, visitor, or guest at its sole discretion. Sierra Tactical Auctions may revoke any bidder’s rights to bid at any Sierra Tactical Auctions, or all future Sierra Tactical Auctions at its sole discretion. You are responsible for all purchases made with your number, whether it was made by you, someone you’ve given the right to use your number, or by error.

Deposits:
We reserve the right to charge a customer’s credit card for a deposit before, during, or after they make a purchase. This is NOT negotiable and NOT left up to interpretation. Bidders may be required to place a refundable deposit for any assets being sold by Sierra Tactical Auctions. Your deposit will be refunded to you upon full payment for your purchases or may be applied to the final payment of your purchases at Sierra Tactical’s sole discretion. If you have made a purchase of multiple items, your deposit will be held and may be used for the last item(s) left unpaid. If you did not win any bids, your Deposit(s) WILL be refunded. The check will be mailed to the address on file. Deposits are refunded to the registered bidder only. A Credit Card deposit is presented to your bank as a pre-authorization/sale and will drop off per your credit card’s terms for pre-authorizations/sales. Please check with your bank or credit card issuer if there are any issues. Please Note: Credit Card and/or Debit Card pre-authorizations/sales and refunds can take up to 30 days.

Buyer’s Premium:
The Buyer’s Premium is specified in the special terms and conditions and also within our fee structure. You are responsible for reading, understanding, and accepting Sierra Tactical’ s current fee structure listed in the catalog and on our website for those fees specific to the auction in which you are participating.

Tax Exemption Qualifications:
All sales are subject to all Local, State, County, and Federal Taxes, including sales taxes unless you have ALL VALID FORMS on file with Sierra Tactical Auctions PRIOR to the auction. Forms include but are not limited to: (1) Sales Tax Exemption Certificate (TPT) acceptable to Sierra Tactical Auctions and to the State of Arizona, (2) COMPLETED Arizona Form 5000 A, and (3) A valid FFL, and (4) Letter of Authorization, if you are not the company owner, and (5) A copy of your Valid State ID. You will not be granted tax exemption post-sale if these forms are not completed to the satisfaction of Sierra Tactical Auctions. Customers and/or Bidders will ONLY be tax exempt for those assets which are listed on the Form 5000 A.

Out of State Tax:
STA does not charge sales tax for out-of-state bidders/buyers. If you pick up in person with an out-of-state ID or out-of-state address on your invoice YOU WILL be subject to paying Arizona state tax of 8.6% – NO EXCEPTIONS

Renege Fees:
Firearm and/or Firearm Surplus Renege / Restocking Fee: Minimum $200 or a 30% of the total bid price, whichever is greater. Fee must be paid to be able to continue to bid in our auctions.

Auction Terminology:
It is the responsibility of the bidder to understand the way items are being sold. THE BIDDER MUST UNDERSTAND WHAT HE/SHE IS BIDDING ON AND HOW IT IS BEING SOLD; IF NOT, PLEASE ASK OR DO NOT BID

Bidder Error:
NO REFUNDS FOR BIDS MADE IN ERROR. Operator error, keystroke mistakes, misunderstanding of auction structure, and other errors are the bidder’s sole responsibility. If you make a bidding error prior to the auctions start time, please contact STA at (602) 558-9393 to correct your bid.

Announcements:
Any announcements made by Sierra Tactical Auctions staff or online auction shall take precedence over any previously distributed information or advertising. By participating in the auction, you have agreed to abide by these announcements.

Addition to or Withdrawal from Sale:
The auctioneer reserves the right to withdraw from the sale any property listed and to add property not listed to the sale. Also, the auctioneer may group lots or subdivide lots to benefit the seller.

ALL SALES ARE FINAL. ALL ITEMS ARE SOLD ‘AS IS-WHERE IS,’ WITH ALL FAULTS AND WITHOUT WARRANTIES. Catalog, web, and ad descriptions are NOT GUARANTEED. Sierra Tactical Auctions is not liable for any errors, omissions, or inaccuracies in the catalog or other written or verbal descriptions even if caused by Sierra Tactical Auctions gross negligence. Bidders are responsible to thoroughly inspect items before bidding and to satisfy themselves of such matters as to suitability, marketability, completeness, year, make, model, and/or condition. IF YOU ARE UNSURE AS TO ANY MATTER, SIERRA TACTICAL AUCTIONS URGES YOU NOT TO BID. YOU MAY NOT RELY ON SIERRA TACTICAL AUCTIONS DESCRIPTIONS OR INFORMATION, WRITTEN OR VERBAL. The auctioneer reserves the right to reject all bids. The auctioneer shall have the right to bid on behalf of the seller. Since Sierra Tactical Auctions discloses ALL fees upfront, it is your responsibility to bid up to a number with which you are comfortable. You control how much you are willing to pay for an item. All auction sales will be recorded by audio and/or in writing. This recording of the bidder’s number and the bid amount shall be prima facie evidence of the circumstances of the sale, and all disagreements will be resolved with this record. Sierra Tactical Auctions is not responsible for any loss or damage to any sold auction items. Ownership and risk of loss or damage transfers to Bidder as soon as each individual lot is sold, subject only to Sierra Tactical Auctions right to reconcile the auction. Errors by auctioneer shall make the sale voidable at auctioneer’s sole discretion. Sierra Tactical Auctions is not responsible for accidents, damages or stolen goods. All counts are approximate. Purchaser should monitor their purchases during the auction; if it is damaged or missing it is the bidders’ responsibility. Sierra Tactical Auctions urges all Bidders to remove all lots from the auction site as soon as possible and highly recommends removal occur no later than the close of business on auction day, with safety and security as the top considerations.

Removal of Purchased Items:
SIERRA TACTICAL AUCTIONS DOES NOT OFFER STORAGE SERVICES
. No item may be removed from the auction site until it is paid for in full and partial payments will be considered additional non-refundable deposits towards the purchase. To avoid daily storage fees, all lots must be removed from Sierra Tactical Auctions facility on the date specified in the special terms and conditions or noted on your invoice. In certain situations, Sierra Tactical Auctions, in its sole and exclusive judgment, may allow certain lots that Sierra Tactical Auctions deems difficult to move to be removed on date mutually agreed upon. A DAILY STORAGE PENALTY of $10.00 per lot, per day shall be charged for all lots not removed on specified removal date. Buyer is solely responsible for the safe removal of all their purchases. Sierra Tactical Auctions, at Buyer’s request, and in its sole discretion, may assist Buyer in the removal of its goods. Buyer shall hold Sierra Tactical Auctions, its employees, officers and directors harmless for any and all damage, injury or liability regarding the removal of its purchases, notwithstanding Sierra Tactical Auctions assistance in item removal.

Arbitration:
In the event a dispute arises between the parties, it is hereby agreed that the dispute shall be referred to an accredited arbitration service at the sole discretion of Sierra Tactical Auctions. Arbitration shall be in Phoenix, AZ, and held in accordance with the applicable Rules of Arbitration. The arbitrator’s decision shall be final and legally binding, and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.

BY PARTICIPATING IN ANY OF OUR AUCTIONS I (the customer) UNDERSTAND AND ACCEPT THE ABOVE TERMS AND CONDITIONS, ESPECIALLY THE KEY TERMS THAT ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO GUARANTEES OR WARRANTIES. I AM SOLELY RESPONSIBLE FOR DETERMINING THE IDENTIFICATION, CONDITION, AND/OR USE OF ALL ITEMS PURCHASED. REFUNDS WILL NOT BE ISSUED AS A RESULT OF ANY DESCRIPTIVE ERROR GIVEN BY THE AUCTIONEER OR AS A RESULT OF MY FAILURE TO PROPERLY IDENTIFY THE ITEM, ITS CONDITION OR USABILITY. After your Invoice is paid in full, you may either pickup in person or YOU MUST contact your preferred FFL Dealer to where you wish to have your Firearms shipped and have them email a copy of their FFL License to firearms@sierratacticalauctions.com. It is solely the Bidders responsibility to provide Sierra Tactical Auctions the copy of the FFL License. It must include your Name, Bidder & Invoice number. If your FFL Dealer requests that we contact them directly to retrieve a copy, you, the bidder, must provide the contact information for the FFL to us via email to firearms@sierratacticalauctionls.com. This too is solely the Bidders responsibility to request in an email and provide the contact information for the FFL.
